Abstract

The object of this paper is the rejection judgment in the Republic of Kosova. The rejection judgment is seen as a decision by which the court rejects the indictment because of the existence of some procedural obstacle. Rejection judgment constitutes a relatively common type of judgment rendered in the criminal proceedings of Kosovo. This judgment will be addressed in several respects within this article. The meaning of the rejection judgment, its characteristics, the criteria for issuing the rejection judgment and the authority to render it, as well as the procedure and effects of this type of verdict are considered in the article. Also, the activity of the Basic Courts of Kosovo regarding issuing the type of judgments during the period 2015 - 2017 is reviewed in the article. Through this paper, we have expectations that concrete actions will be taken to improve the performance of judges and prosecutors; which might include much needed vetting for prosecutors and judges in the country. There is all the more reason for this as Kosovo has already crossed over to a overwhelmed justice system, as prevailing international public opinion has it. During the preparation of this article legal, comparative, method of analysis and statistical method were made use of.
