Abstract

The article deals with the right of suspects and the accused not to be compelled to testify against themselves or to confess guilt in a criminal trial in Finland during the investigation of cases of bankruptcy and debt collection. ECHR in April 2009 found a violation of Article 6 of the European Convention in Marttinen v. Finland on the basis of which the Supreme Court cancelled 20.10.2009 Finland’s earlier verdict in a criminal case co reference to article 6 of the European Convention. The article discusses the basis and amendments to Finnish legislation with reference to the suspect’s right to a fair trial guaranteed by Article 6 § 1 of the Convention.
